Payment of Compensation to Class Action Occupants
(Approximately 120 days after the judgment)
Following the hearing held on February 25, 2026, the Honourable Martin F. Sheehan, J.S.C., took the final submissions of all parties under advisement.
The judgment was rendered on March 3 ,2026, the claims period will be open for a duration of 90 days ( until June 3, 2026). An additional 30-day period will then be required to review the claims received and to determine the value of the monthly loss-of-use units, in accordance with the approved distribution plan. Accordingly, payment of compensation should be expected approximately 120 days following the final judgment ( July 3,2026)
Reimbursement of Advances Paid by Class Members
(Approximately 30 days after the judgment)
The defendants will have 15 days following the judgment to pay the amounts owed under the settlement agreement.
Thereafter, the class action administrator, Reglex Solutions, will proceed with the reimbursement of disbursements incurred by ABC Lawyers.
ABC Lawyers will then reimburse the amounts advanced by the class members.
When will the claims period open?
The claims period is now open as the judgment was rendered on March 3 ,2026. The claim periode will remain open for 90 days ( June 3 , 2026).
Reglex Solutions, as the class action administrator, will notify by email all members who have registered on Reglex.ca.
How can I submit a claim?
Once the claims period opens, a court-approved claim form will be made available on Reglex.ca.
The class action administrator will contact class members and invite them to submit a claim by completing the claim form provided.
