The class action alleges, among other things, that the defendants are liable for damages associated with the loss of enjoyment suffered by the occupants of the condominiums located at 240, 260, 270, 280, 290, 300, and 310 Boulevard de l’Europe, as well as at 155 rue de Londres in Gatineau, during major renovations carried out between May 2016 and March 2019. The plaintiff alleges that the defendants are responsible for the damages caused by construction defects and poor workmanship in the buildings. The applicant alleges that the occupants suffered a loss of enjoyment of their condominium units during the remedial work (noise, dust, loss of access to certain rooms, loss of balconies, invasion of privacy, stress, etc.).
Eligibility Criteria
Having been an occupant of the condominium units during the period of the work carried out between May 1, 2016, and March 31, 2019. The term “condominium unit” refers to one of the 96 units located at 240, 260, 270, 280, 290, 300, and 310 Boulevard de l’Europe, as well as 155 Rue de Londres in Gatineau.
- Occupancy means being one or more persons who reside there as an owner, co-owner, tenant, co-tenant, spouse, resident, or dependent.
- To have been an occupant of one of the 96 units located at 240, 260, 270, 280, 290, 300, and 310 Boulevard de l’Europe, as well as at 155 rue de Londres in Gatineau.
- To have resided at and chosen this address as your principal residence during part or all of the construction period from May 1, 2016, to March 31, 2019.
- If any funds remain available after the initial distribution, non-occupant co-owners may submit a claim, provided that the conditions set out in the Distribution Plan are met, including the absence of an accepted claim from the tenant and proof that the unit was rented during the relevant periods.
Status of the application: where are we now?
The first step has been completed: the application for authorization to institute a class action was filed by the law firm ABC Avocats with the Superior Court of Quebec, Gatineau District, on May 6, 2019 under court file number 550-06-000031-196. The Class action was authorized on January 19th 2026. the deadline to opt out expired on February 23rd 2026 at 17:00 (EST). A hearing to approve the settlement agreement was submitted on February 25th , 2026. The final decision of Honourable MArtin F. Sheehan, J.S.C. was published on March 3, 2026.
Next Steps
In the class action Durand v. 6647553 Canada Inc. (Construction Danmar) et al., a settlement has been reached between the defendants and Sébastien Durand. This settlement will has been submitted to the court for approval on February 25th, 2026. The final decision of Honourable Martin F. Sheehan, J.S.C was published on March 3 , 2026 . The claim period will be open for 90 days, until June 3, 2026. Reglex Solutions will contact registered members to inform them of the status of their claim once it has been processed. Payment will be issued within 30 days following the end of the claim period, that is, by July 3, 2026.

Are there any fees for class members?
No. Lawyers will be paid from any amounts recovered through the class action, if any. The Court will determine the reasonableness of the plaintiffs’ lawyers’ fees, which cannot exceed 30% of the amounts recovered by judgment or out-of-court settlement. Furthermore, if you have not personnaly intervend in this proceeding, you will not be required to pay fees for the class action.
